Terms of Service

Welcome to Open Nvite. These Terms of Service ("Terms") govern your access to and use of the Open Nvite web application and related services (collectively, the "Service"), operated by Open Nvite ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must meet all of the following requirements to use Open Nvite:

  • You are at least 21 years of age.

  • You are currently located in the United States.

  • You are registering as an individual, not on behalf of a business or organization.

  • You are legally capable of entering into a binding agreement.

  • You have not been previously suspended or removed from the Service.

By creating an account, you represent and warrant that you meet all eligibility requirements. We reserve the right to request verification of your age or identity at any time. Providing false information is grounds for immediate termination of your account.

2. Account Registration

To use Open Nvite, you must create an account by providing accurate and complete information, including your full name, email address, date of birth, and gender. You may also register using a third-party service (such as Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@opennvite.com if you suspect unauthorized use of your account.

You may only maintain one account. Duplicate or fraudulent accounts may be removed without notice.

3. The Service

Open Nvite is a social platform that allows individual users to create and join real-world shared experiences ("Moments"). Moments are in-person events created by individual users in their local area. The Service is currently available only within the United States.

We do not organize, host, or sponsor Moments. We are not responsible for the conduct of any user before, during, or after a Moment. Participation in any Moment is entirely voluntary and at your own risk.

4. User Conduct

By using Open Nvite, you agree not to:

  • Use the Service if you are under 21 years of age.

  • Create or attend Moments for any illegal purpose.

  • Harass, threaten, stalk, or harm any other user.

  • Post or share false, misleading, or deceptive information.

  • Impersonate any person or entity.

  • Use the Service to promote commercial activity without authorization (all business accounts require a separate vetting and onboarding process — contact us at hello@opennvite.com).

  • Circumvent or attempt to circumvent any safety or security feature of the Service.

  • Use automated tools, bots, or scrapers to access the Service.

  • Violate any applicable law or regulation.

Violation of these rules may result in immediate suspension or permanent termination of your account.

5. Safety Policy

All users are required to read and agree to our Safety Policy before creating an account. Open Nvite is committed to fostering a respectful and safe community. We take reports of unsafe or inappropriate behavior seriously. To report a safety concern, contact us immediately at hello@opennvite.com.

You acknowledge that meeting strangers in person carries inherent risk, and that Open Nvite cannot guarantee the safety of any in-person interaction. You agree to use good judgment and take reasonable personal safety precautions.

6. Content

You retain ownership of any content you submit to the Service (such as moment descriptions, profile information, or images). By submitting content, you grant Open Nvite a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating the Service.

You are solely responsible for the content you post. You agree not to post content that is unlawful, obscene, defamatory, discriminatory, or that violates the rights of any third party. We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is otherwise inappropriate.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Third-Party Services

The Service uses third-party services including Google (authentication), Mapbox (location search and mapping), Supabase (data storage), and Resend (email notifications). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service providers.

9. Intellectual Property

The Open Nvite name, logo, and all related marks, designs, and content created by us are our exclusive intellectual property. You may not use our branding or content without our prior written permission. Nothing in these Terms grants you any ownership of our intellectual property.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OPEN NVITE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Open Nvite and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may delete your account at any time by contacting us at hello@opennvite.com. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Georgia, and you consent to the jurisdiction of such courts.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
